Failure to Yield Accidents

Stop signs and stop lights are designed to be clearly visible so that they can help to regulate traffic and prevent accidents. Unfortunately, sometimes people fail to notice these signs or outright disregard them and do not yield properly. When a driver runs a yield sign, stop sign, or stoplight, he or she could cause a serious accident resulting in catastrophic injury or death.

If you have lost a loved one in an accident that occurred because a driver failed to yield the right of way, you may be able to recover compensation for your loss. Contact the Pennsylvania wrongful death lawyers of Lowenthal & Abrams, P.C., at 610-667-7511 to learn more about your legal rights from a compassionate and experienced attorney.

Determining Liability

When a driver fails to yield on a street or at an intersection, he or she is considered to be at fault for the accident. If the at-fault driver does not possess insurance or your damages exceed the amount covered by his or her insurance, you may be able to sue for damages such as medical costs, funeral expenses, lost income, and pain and suffering.

One key determination in any failure to yield accident is to find out who is responsible for the dangerous conditions that led to the accident. While the other driver is often the one at fault, other possible parties that may be responsible include:

  • The city or municipality in charge of maintaining the roads. A sign may have been partially obscured or a stop light may have malfunctioned, causing the accident.
  • The vehicle manufacturer. The driver’s brakes may have failed or some other malfunction may have prevented them from stopping to avoid the accident.
  • The venue that last served alcohol to the driver. If the other driver was intoxicated, the venue that last served alcohol to him or her may be legally liable for the accident. In Pennsylvania it is illegal to serve alcohol to anyone who is visibly intoxicated.

Our attorneys are prepared to investigate your case to determine who is liable for the accident so that you can recover the financial compensation that you are rightfully owed.
