A wrongful death lawsuit against a Ramada hotel will go forward with a ruling that the facts presented are to be considered as true. A 17-year-old employee was killed in a car accident in 2006 with a high blood alcohol level. His pickup crashed through a fence and into a pond, killing the boy. His blood alcohol level was at 0.14 percent. Pennsylvania law does not allow anyone to drive if they have 0.08 percent or higher, and drivers under age 21 cannot be over 0.02 percent.
Prosecutors say Ramada should not have allowed the boy to work the extended 16-hour shift as a dishwasher and waiter, violating child labor laws. They also accused the hotel of allowing the boy unfettered access to alcoholic beverages on the job, saying that the bartender left two minors unattended for two hours with free access to alcoholic beverages.
