Wrongful Death Lawsuit Filed Against Disney Over Monorail Death

A preliminary hearing will be held in Orange County, Florida Thursday afternoon in the wrongful death lawsuit filed by the family of a Disney monorail driver who was killed on the job.
The wrongful death lawsuit, filed against the Disney Corporation, was brought by family members on behalf of 21 year-old Austin Wuenenberg, who was killed in a crash involving two monorail trains at Walt Disney World in July 2009. According to the lawsuit, Disney has not been forthcoming with information surrounding the incident. A lawyer for the Wunnenberg’s family said Thursday’s hearing involves a motion by the plaintiff to get more access to records that Disney claims are confidential.
An investigation into the incident by the Orange County Sheriff’s Office revealed the supervisor in charge of switching the two monorail trains was at an off-property restaurant at the time of the crash, and could not see the trains he was directing.

Settlement Reached in CA Botox Wrongful Death Lawsuit

Two siblings in Santa Ana, California have settled a wrongful death lawsuit filed against Allergen Inc., in which they claimed the drug Botox led to their mother’s death.
The brother and sister filed a wrongful death lawsuit in July 2008 on behalf of their 69 year-old mother, Sondra Bryant. Bryant received Botox injections from 2005 to 2007 to help with neck and shoulder pains, according to the lawsuit. The suit claimed the drug led to Bryant’s death.
A spokeswoman for the Irvine-based Allergan Inc, Caroline Van Hove, said the company would not release any details on the settlement, which was announced Thursday – the same day trial was set to begin.
Botox is widely used to reduce wrinkles, but has also been used to treat migraines, cerebral palsy, and muscular pain.

Pennsylvania Wrongful Death Lawsuit Brought Against Drunk Driver

A woman in Pennsylvania has filed a wrongful death lawsuit against the driver who struck and killed her husband last year.
According to court documents, Karen Ampomah filed a civil lawsuit in county court in May 2009 for the wrongful death of her husband Festus. Police say 46 year-old Justofin was driving a Dodge Ram pickup on chestnut Hill Drive last year, when he struck Ampomah as he was walking along Route 924 in Hazel Township. Justofin allegedly drove away from the scene and told his sons he hit a pedestrian.
Police said Justofin had a .186 percent blood-alcohol content hours after the crash. The legal limit to drive in Pennsylvania is .08 percent.
The wrongful death lawsuit says the defendants “maliciously” and “recklessly” caused the death of Ampomah, and seeks $400,000 in damages.
Justofin has been sentenced to 7 years in prison, and three years probation.

$131M Verdict in Ford Wrongful Death Lawsuit

A jury in Mississippi returned a $131 million verdict against Ford Motor Corp in a wrongful death lawsuit.
According to Jasper County Circuit Court records, the family of Brian Cole have been awarded $131 million from the automaker after Cole was killed in a rollover accident in his Ford Explorer SUV. Cole was a minor league baseball player and was being considered for the New York Mets at the time of the accident.
Ford spokeswoman Marcey Evans said the company was not at fault in the accident: “This was a tragic accident and our sympathy goes out to the Cole family for their loss, but it was unfair of them to blame Ford.”
Evans claimed Cole was driving over 80 miles per hour without a seat belt at the time of the crash. Attorneys for Cole’s family, however, maintain that he was buckled in when the crash occurred. “His belt was still buckled after the accident was over but he was thrown from the car,” Cole’s family attorney Tab Turner said.

Wrongful Death Lawsuit Filed Against Manufacturer of Railcar Elevator

The family of a man in Texas, who was killed using a railcar elevator, has filed a wrongful death lawsuit against he machine’s manufacturer.
According to court documents filed Gregg County, Texas, Jacquelin Ferguson has filed a lawsuit on behalf of the deceased Eric John Ferguson against Compton Enterprises Inc. The lawsuit contends that Eric John Ferguson received fatal injuries while he was using a Compton railcar elevator on July 17. Ferguson was killed when he was swept into the transloader.
The lawsuit claims that the transloader was dangerous, as it was unguarded and contained no kill switch or emergency cut-off device. The defendants are accused of defective design, defective manufacturing and defective marketing. The suit also alleges failure to warn and negligence.
The plaintiffs are seeking damages for conscious physical pain, emotional pain, torment and suffering, medical expenses, and funeral expenses.
