Boston Wrongful Death Lawsuit Filed Over Dangerous Handrails

The widow of a North Carolina man killed in an auto accident has filed a wrongful death lawsuit against eight contractors over the design of handrails in Boston’s Sumner Tunnel.

According to Suffolk Superior Court documents, 39 year-old Brian Hicks was killed March 27 after he struck a Jersey barrier inside the Sumner Tunnel is Boston, lost control of his pickup truck, and was ejected from the vehicle. Hicks became entangled in the tunnel’s razor sharp handrails. The lawsuit, filed Monday by Donna Hicks, allege that eight Big Dig contractors knew the design of the railings was inherently dangers but failed to take any actions to address the problem.

Donna Hicks’ attorney Barry Feinstein said Hicks, who wasn’t wearing a seat belt and may have been going too fast for the curve, might well have survived the crash if not for the handrails.

Hicks is asking the court for just under $2 million in actual damages plus additional damages to be determined by a jury.

$3.3M Verdict in Maryland Wrongful Death Lawsuit

A jury has awarded a $3.3 million verdict in a wrongful death lawsuit filed against the state of Maryland.

According to court documents, the lawsuit was filed on behalf of Kelay Smith, who was struck by a vehicle along a portion of roadway where other pedestrians had been hit and killed before. The lawsuit alleged Smith was hit because a potion of the roadway had no sidewalk.

According to the lawsuit, the 26 year-old Smith was walking home wither her 22 year-old sister Krystal when she and another pedestrian were struck by a vehicle driven by 30 year-old Derrick R. Jones. Jones died at the scene of the accident and Smith, who was five months pregnant at the time, died at a nearby hospital along with her unborn child.

The lawsuit claimed the accident could have been prevented had there been a sidewalk for pedestrians to walk on and guardrails. The gap without a sidewalk was about 200 feet in length, and Smith and Jones were both on that portion of the roadway when they were struck.

$2M Verdict in CA Wrongful Death Lawsuit

A jury in California awarded $2 million to the family of a woman killed in an auto accident at a dangerous intersection in 2008.

According to Madera County Superior Court documents, 31 year-old Suzanna V. Coronado was killed in a car accident on July 5, 2008, at an intersection the jury found to be a dangerous condition of public property.

Coronado and her husband Michael were riding a motorcycle southbound on Highway 41 when a vehicle driven by Alexander Huerta pulled out from Road 416 to travel north on the highway. When Coronado rounded the curve on a downhill grade the motorcycle went down because Huerta’s vehicle was completely obstructing the southbound lanes.

Michael Coronado filed a lawsuit against the State of California Department of Transportation alleging that the intersection where the accident occurred was in a dangerous condition and that the Caltrans had notice of a lengthy history of broadside-patterned accident at the intersection. The jury agreed with Coronado and returned a verdict of slightly more than $2 million.

2 Killed in 2-Car Pennsylvania Crash

Two people were killed in a two-vehicle car accident in central Pennsylvania Wednesday.

According to officials with the Lancaster County Sheriff’s Department, the fatal crash occurred shortly after 3:30 p.m Wednesday on Route 272 in East Drumore Township. The county coroner’s office says two people, a man and a woman traveling in the same car, were pronounced dead at the scene of the crash by Deputy Coroner Carol Rottmund. Their names were not released pending notification of family members.

Fire companies from Rawlinsville and Quarryville were called to the scene along with several ambulances and medic units.

6-Year-Old Struck by School Bus Dies

The child who was struck by a school bus in Pennsylvania last Wednesday has died, police say.

The unidentified boy died Tuesday, the same day he would have finished the first grade. According to officials with the Pennsylvania state police the  six-year-old boy was run over by the same school bus that drove him home. He was struck near his house on Ferncroft lane. Superintendent Lawrence Mussoline said the boy got off the bus a few hundred yards up the street from his house. As the bus started driving  away, he began running alongside it and darted in front of the bus when he saw his mother.

“The entire district is grieving with the family,” Mussoline said. “We are a very large district but we care deeply about each one of our students. This is a very tragic day. Speaking with everyone across the district, heartfelt thoughts and prayers are with the family.”

Upper Uwchlan Police Chief John DeMarco declined to identify the school bus driver. There is no word on whether a wrongful death lawsuit will be filed.

Bar is found primarily responsible in wrongful death case

A jury recently ruled that the majority share of negligence rested on a bar’s shoulders in a drunk driving wrongful death case.

According to the jury, the standards that were put in place to get the bar’s license to serve liquor in the state of Pennsylvania were ignored by the bar’s staff. The bartenders continued to serve the now-deceased woman on November 5, 2006, even though she was clearly intoxicated. As a result, she left the bar with a blood alcohol toxicity roughly three times over the legal limit. Following her exit from the bar, she got in her car and proceeded to try to drive home. She crashed around Delaware Avenue, suffering fatal injuries.

While the bar was in its rights to serve alcohol, limitations put in place in Pennsylvania makes it a violation to serve alcohol to someone who is visibly over-intoxicated. The message of the jury’s decision was that all bars and restaurants will be held accountable for their social responsibility to carefully monitor their patrons. As a result, the jury placed 51% blame on the bar and 49% blame on the woman, discounting the appropriate amount of judgment from the total claim against the bar. Many hope this case will instill moral accountability alongside profitability in any mistaken club and bar owners’ priorities.

Teen crash study released

In an attempt to lower fatality rates with teen drivers, a new survey has enumerated the four largest contributing forces to teen crashes.

State Farm and the Children’s Hospital of Philadelphia backed the National Young Driver Survey, a questionnaire completed by 5,665 teen drivers that aimed to illuminate the causes of young drivers’ mistakes. According to the results, 84% of crashes involving teens can be blamed on their four factors.

The first factor listed was the teenager’s inexperience driving. The study asked that teen drivers wait 6 to 12 months before letting friends ride along with them, as at least two-thirds of all fatal teen crashes can be blamed on driver error.

Secondly, distractions presented to the driver contributed heavily to fatal crashes with teens. The study blamed multiple passengers and cell phones, regular or hands-free models, for the three to five times increase in deathly collisions.

The third cause in the study was speeding. Males between the ages of 15 and 20 are caught speeding in 38% of fatal incidents.

Fatigue and drowsiness are the fourth factor. Teens coming back from late-night activities at school or their friends’ houses can pose a serious danger.

Looming problems for Toyota owners

Recall woes may not be over for Toyota.

According to reports filed by a 66 year-old woman from Philadelphia, her Lexus RX350 accelerated without her touching the accelerator pedal, causing her to crash the car in order to stop it from going any faster and causing even more damage. The report to the attention of the public while Congress continues an on-going investigation into Toyota.

Congress recently urged the automaker to install new brake interlock systems and a black box to record the status of a vehicle prior to a collision.

Another family sued Toyota in 2008 for unsafe accelerator pedals after their son died in an ensuing accident. They were also in a Lexus RX350.

Consumer reports find themselves against the Lexus line of models, commonly citing safety issues especially with the RX350 model and SUV classed GX460. Recalls did not go out for the RX350, as some suspect lower sales meant lower number of incidents, causing less exposure of problems. The GX460 was recalled, seeing a reworking of the vehicle’s software.

Philadelphia woman killed after car jumps sidewalk

On Tuesday at 4:00 p.m., a car ran up a Philadelphia city sidewalk, killing an 18 year-old woman.

Following a car accident at the intersection of Olney Avenue and 2nd Street near Albert Einstein Medical Center, a car jumped the curb and continued on to strike the woman on the sidewalk and eventually stop by crashing into a porch. A southbound car struck that car, which was traveling north, while turning onto Olney Avenue to go east.

The woman died around 9:50 that Tuesday night, suffering from a head injury and multiple fractures. The two motorists involved in the accident were taken to Albert Einstein Medical Center following the incident, and were subsequently treated for their respective minor injuries.

No charges have been filed by the police although an ongoing investigation is open.

Cyclist hit, killed in Blair County

A bicycle rider was involved in a fatal accident Thursday evening when a vehicle struck him on the roadway in Snyder Township, Pa., authorities said. The 50-year-old cyclist was traveling southbound as the vehicle driver was traveling northbound on the same road. The vehicle made a left-hand turn at an intersection, police said, and hit the bicyclist.

The driver said he could not see the cyclist because the sun was blinding him. The bicyclist was pronounced dead on the scene of blunt force trauma from the bicycle accident, authorities said.
