Wrongful death trial in Maryland begin closing arguments

In Baltimore, Maryland the closing arguments have begun for a wrongful death trial. The trial revolves around a murder that happened on an inmate bus in the state of Maryland.

Prison inmates were being transported from one location to another when an inmate was brutally killed by another inmate. The parents of the inmate that was murdered are claiming negligence by the state. According to them, there were five officers on the bus that did nothing to stop the attack from occurring. The inmate officially died from being strangled.

The plaintiffs are looking to make $21 million from the outcome of this wrongful death suit.

Wrongful death suits filed in cantaloupe recall

A massive cantaloupe recall has been linked to strains of the listeria bacteria which has left as many as 15 dead.

The recall was made by the Food and Drug Administration and was directed towards the Rocky Mountain Cantaloupe from Jensen Farms located in Holly, Colorado. As of now, 84 people have been affected by this outbreak across 19 states.

The outbreaks have been almost impossible to contain due to the fact that those affected by listeria can seem to have recuperated from the disease only to be struck again with more devastating results.

The wrongful death lawsuits are being filed by the families of the victims and are being directed towards Jensen Farms and Wal-Mart, a distributor of the produce.

Last wrongful death case of 9/11 settled

A family in Boston was the last to complete a wrongful death lawsuit relating to the terrorist attacks that took place on September 11, 2001.

The victim of the attack was on board the United Airlines Flight 175 when it was flown into the World Trade Center. The lawsuit was centered around airport security, that the defendants believed wasn’t strong enough, at the Logan International Airport where both of the flights that ultimately crashed into the twin towers took off from.

Out of the almost 3,000 casualties of the attacks, this Boston family fought the longest and hardest to keep their case circulating in the court system.

The family is drained and overwhelmed at the close of this case.

The case was settled for an undisclosed amount.

Methadone overdose leads to Wrongful Death Lawsuit

A wrongful death lawsuit has been filed by the wife of a man who died from a methadone overdose in a West Virginia hospital.

Joseph Connolly had a history of overdosing on alcohol, Ambien, and Xanax, and was admitted to the emergency room at Potomac Valley Hospital on June 8th for treatment. He died five days later after overdosing on methadone that was given to him by his physicians.

According to the lawsuit, Connolly’s physician prescribed 40 mg of methadone after he believed his patient was already taking 50 mg of methadone twice a day. When Connolly was transferred to Chestnut Ridge Hospital, his physician there gave him another dosage.

The lawsuit, which was filed in Monogalia Circuit Court last month by Connolly’s wife, claimed that his death was due to respiratory and cardiac arrest following a methadone overdose. Connolly’s wife believes the physicians’ negligent care is to blame for her husband’s death, since his lab work showed that he was actually not on methadone at the time he was admitted.

$600K Settlement in Mass. Gun-Maker Wrongful Death Lawsuit

A Massachusetts gun-maker has agreed to pay nearly $600,000 to settle a wrongful death lawsuit.

According to court documents, Kahr Arms has agreed to pay the families of one man killed and another man wounded in a shooting involving a gun allegedly stolen from the company. The lawsuit was filed by the family of Danny Guzman, who was slain outside a Worcester nightclub in 1999, and the family of the wounded man. The lawsuit alleged the gun used in the attack was stolen and later sold by a Kahr employee with a criminal record.

According to a statement released by the Brady Center to Prevent Gun Violence, the settlement is the largest damages payment ever made by a gun manufacturer accused of negligence leading to the criminal use of a gun. Gutzman’s relatives say the gun manufacturer should have done employee background checks in their hiring process. The lawsuit also claimed it was common practice to use metal detectors to prevent gun thefts, which Kahr failed to do.

Family of Man Killed by Chicago Taxi Files Wrongful Death Lawsuit

The family of a man killed by a Chicago taxicab has filed a wrongful death lawsuit against the driver and the cab company.

According to court documents, 47 year-old Hector Palencia Sanchez, of Chicago’s Roger Park neighborhood, was killed when he was struck by a cab as he walked along a sidewalk last month. He was pronounced dead at the scene of the accident. The cabdriver, 71 year-old Yao Ofori, and a 51 year-old female passenger were transported to Northwestern Memorial Hospital.

The wrongful death lawsuit was filed against the Wolley Cab Association, Checker Taxi, and Ofori.

Witnesses said Ofori veered across several lanes of traffic before striking Palencia Sanchez. He was ticketed for driving too fast for road conditions and striking a pedestrian, police said.

According to records, Ofori has been issued 30 traffic tickets in 22 years.

The wrongful death lawsuit was filed on behalf of Palencia Sanchez’s mother, three sisters, and two brothers. The family claims Ofori and the taxi companies were negligent and failed to exercise care and caution that “a reasonable person under similar circumstances would have exercised.”

$25M Wrongful Death Lawsuit Filed Over Police Shooting Death of California Man

The City of Manteca, California and the police department have been named in a $25 million wrongful death lawsuit.

According to court documents, the lawsuit was filed over the officer-involved shooting death of Ernesto Duenez. The lawsuit alleges that officers wantonly killed Duenez on June 8 when he was “clearly unarmed and not a risk of harm to anyone.”

Attorneys of the Duenez family, John Burris and Ben Nisenbaum, say the killing was a tragedy that appears to have been caused by the reckless conduct of at least one of the Manteca Police Department’s officers. The attorneys claim that press accounts falsely claimed that Duenez had approached officers with a knife, a gun, or a weapon. Burris says several witnesses have refuted the claims that Duenez had a weapon.

In addition to the claim for $25 million in general damages, the Duenez family is also asking the court for special damages in a sum according to proof; punitive damages in a sum according to proof; reasonable attorney’s fees; injunctive relief; cost of the suit incurred; such other and further relief as the court deems just and proper.

$10 Million Verdict in UCF Wrongful Death Lawsuit

A jury in Florida returned a $10 million verdict in a wrongful death lawsuit filed against the University of Central Florida’s Athletic Association.

The wrongful death lawsuit was filed against the Univeristy’s Atheletic Association by the parents of Ereck Plancher. Plancher collapsed and died following conditioning drills at the school’s football complex in March 2008. During the trial, Orange County Medical Examiner Joshua Stephany and three experts hired by Plancher’s family testified he died from complications of a sickle cell trait.

The lawsuit claimed school officials, who knew of Plancher’s sickle cell trait, were negligent by forcing the player to complete overly-strenuous practice drills.

The attorney for the Plancher family, Steve Yerrid, says the verdict sends a message that the welfare of student athletes should be at the top of any football program.

University of Central Florida spokesman Grant Hetson says the football program mourns Plancher’s death, but the athletic association will appeal the verdict.

$25 Million Lawsuit Filed Over Cornell Fraternity Hazing Death

The mother of a Cornell University student who died during an alcohol-related fraternity hazing ritual has filed a wrongful death lawsuit against the fraternity.

According to court documents, Marie Lourdes Andre filed a multimillion-dollar wrongful-death lawsuit against the Sigma Alpha Epsilon Fraternity and its Ithaca chapter officers and members. The fraternity, which was founded in the 1850s, consists of 241 national chapters with about 11,000 undergraduate members.

According to the lawsuit, Andre’s son, George Desdunes, was found by Cornell personnel on February 25 unconscious on a couch at the Sigma Alpha Epsilon house in Ithaca and later was pronounced dead. The lawsuit alleges that Desdunes was kidnapped by fraternity pledges in a ritual in which fraternity members bound his wrists and ankles with zip ties and duct tape, quizzed him about fraternity lore, and made him drink alcohol until he passed out.

SAE pledges and members took Desdunes, still bound, to the fraternity house and left him on the couch to die, the lawsuit alleges.

Three former pledges at Cornell pleaded not guilty to misdemeanor charges in connection with the death.

Wrongful Death Lawsuit Filed by September 11 Victim’s Family

The family of a Boston man who were killed in the 9/11 terror attacks on the World Trade Center has filed a wrongful death lawsuit against Logan International Airport.

Bavis, whose twin brother, Mark, died aboard United Airlines Flight 175, which was flown into the World Trade Center’s South Tower by terrorists, filed a wrongful death lawsuit claiming the Logan International Airport did not know how to spot Mace and had trouble speaking English.

“What’s really shocking for me is it has taken more than nine years for this to come out,” Mike Bavis said.

According to the lawsuit, security screeners at the United Airlines gate on September 11, 2001 were “unable to identify mace or did not know what mace was.” The lawsuit also claims the general manager for the security company at the gate was “unaware” of a federal alter that “Osama bin Laden and his terrorist network” were targeting American passenger jets. Bavis claims the security workers “could not communicate in English well enough to perform their passenger-screening duties.”

A spokesman for United Airlines refused to comment on the wrongful death lawsuit.
