$4.6M Settlement Awarded in CA Firefighter Wrongful Death Lawsuit

The family of a California fire fighter was awarded a $4.6 million settlement Tuesday in a wrongful death lawsuit filed against two private alarm companies.

According to Contra Costa County Court documents, the family of 37 year-old Scott Desmond filed a lawsuit against alarm dealer Pinnacle Security and alarm monitoring company Security Associates International, after Desmond died in a fire at a home in San Pablo. The lawsuit claimed the tragedy could have been adverted had the fire been properly dispatched by the alarm companies.

There was a 10 minute delay between the time Gayle Moore notified a Pinnacle employee through an intercom that there was an active fire in her house and the time the first fire crew was dispatched. Evidence shows that a Pinnacle representative called the Contra Costa Fire District’s non-emergency dispatch line and said there was a fire alarm report, rather than relaying that the homeowner said a fire was burning.

Blackwater Wrongful Death Suit Dismissed

A federal judge has dismissed a wrongful death lawsuit against the former Blackwater USA.

The lawsuit was dismissed because the plaintiff could no longer afford to pay for the proceedings. According to court documents, the lawsuit claimed Blackwater (now Xe Services) was responsible for the deaths of four contractors in 2004. The lawsuit has dragged on for sex years. Katy Helvenston, mother of slain contractor Scott Helvenston, said she wanted the case to proceed, but could no longer afford it.

“It’s pretty much destroyed my life,” Helvenston said. “I haven’t known one moment of joy since Scotty was slaughtered. … I felt so betrayed.”

The contractors were killed by insurgents in an ambush that precipitated the battle of Fallujah. A congressional investigation found that Blackwater was “unprepared and disorderly,” sending the contractors out in an unarmored vehicle and without basic equipment.

$700K Settlement in Bradley University Wrongful Death Lawsuit

The family of a Bradley University sophomore, who died more than three years ago in a fatal college prank, has settled a wrongful death lawsuit with three of his roommates.

According to papers filed in Peoria County Circuit Court, the family of Sheridan Dahlquist will receive $300,000 from insurance policies held by his roommates Ryan Johnson and Nicholas Mentgen, as well as Mentgen’s parents, Ronald and Jeanne Mentgen. The insurance policy of David Crady, who also lived at the house, will pay out $100,000, for a total settlement of $700,000.

The lawsuit, filed in August 2009, alleged negligence and “willful and wanton misconduct,” claiming the four friends “disregarded the safety and welfare of [Dahlquist] and started a fire in [his] bedroom…” The four roommates had been drinking with Dahlquist and playing pranks with fireworks the night of his death. The three men stuck two roman candles beneath Dahlquist’s bedroom door and shot about 10 balls of fire into the room. The room caught fire and Dahlquist was killed.

$5M Settlement in Chewing Tobbacco Wrongful Death Lawsuit

A $5 million settlement has been reached in a wrongful death lawsuit filed against a chewing tobacco company.

According to court documents, the lawsuit was filed by the family of Bobby Hill, a North Carolina man who died in 2005 as a result of tongue cancer. The lawsuit named U.S. Smokeless Tobacco Co. as the defendant. Hill’s family calimed he used the company’s products since he was 13.

The wrongful death lawsuit accuses Smokeless Tobacco Co., makers of Skoal and Copenhagen chewing tobacco, of selling a defective product, which is addictive and sometimes lethal, without properly warning consumers about the potential risks associated with chewing tobacco side effects. The family alleged that chewing tobacco was being marketed as a harmless alternative to cigarettes.

Wrongful Death Lawsuit Filed Against Haunted House Operators

The father of a 15 year-old girl who died after an asthma attack last year has filed a wrongful death lawsuit against the operators of a haunted house.

According to the lawsuit, the haunted house failed to warn people with respiratory problems of the existence of fog inside the venuel. The family of 15 year-old Brittney Holmes belives the fog and scents triggered her fatal asthma attack. The operators of the Darkness Haunted House claim three ten-foot signs outside the venue carried sufficient warnings.

According to court documents, Holmes vistited the haunted house in October 2009 and suffered an asthma attack on the ride home, which deprived her brain of oxygen. Homes died in November after spending a year in a vegatative state.

Joe Jackson Re-Files Wrongful Death Lawsuit Against Son’s Doctor

Michael Jackson’s father, Joe Jackson, has re-filed a wrongful death lawsuit against the physician who was treating his son at the time of his death.

The lawsuit was filed Tuesday in California Superior Court by Jackson’s attorney Brian Oxman. The filing claims that Murray wrongfully provided painkillers, including the anesthetic propofol and a “polypharmacy” of other drugs that resulted in Michael Jackson’s death. Murray is also accused of evidence tampering at the scene of Jackson’s death. He reportedly asked security guards to clean the singer’s room before police arrived, according to the filing.

The re-filed wrongful death lawsuit also names Las Vegas Applied Pharmacy Services, claiming the company was negligent in selling the drugs to Murray.

Michael Jackson died of cardiac arrest on June 25, 2009. His death was ruled an overdose on painkillers.

$80M Verdict in R.J. Reynolds Wrongful Death Lawsuit

A jury in Florida has ordered R.J. Reynolds to pay $80 million in a wrongful death lawsuit filed by the daughter of a man who smoked for six decades and died of lung cancer in 1996.

According to court documents, Dianne Webb filed a wrongful death lawsuit over the death of her father, James Cayce Horner, claiming his death was caused by an addiction to smoking. Jurors found the cigarette maker was 90 percent at fault in Horner’s death. Horner, said to have smoked two packs a day, was 10 percent to blame, according to the jury.

The award consists of $8 million in compensatory damages and $72 million in punitive damages. David Sales, Webb’s attorney, said he is satisfied with the ruling. “People need to be reminded, again and again, of the true cost in precious human life, that R.J. Reynolds has imposed and continues to impose on our society,” Sales said.

R.J. Reynolds spokesman David Howard said the company will appeal the verdict. “We’re disappointed with the jury’s decision in the matter,” Howard said.

$154K Verdict in NY Wrongful Death Lawsuit

A jury in New York returned a $154,000 verdict against a hospital in a wrongful death lawsuit filed by the family of a man who died after he was given an incorrect painkiller.

A state Supreme Court jury deliberated for nearly four hours before finding that the family of Leo Bruce Sr. should be compensated for his January 2005 death at Glens Falls Hospital. The 66 year-old was given a powerful dose of the painkiller OxyContin that was meant for his hospital roommate, during a stay at the hospital last year. Bruce was pronounced dead about 12 hours later.

Bruce, who suffered from a breathing disorder,  had been admitted to the hospital for observation when a nurse wrongly gave him the painkiller, which was meant for a cancer patient in the next bed. OxyContin can depress respiration, and the hospital admitted liability in the death.

Bruce’s family and the hospital set a range for damages, between $100,000 and $325,000, agreeing not to appeal if the verdict fell between those figures.

“I think the jury made a reasonable analysis,” said attorney William Nikas, who represents the Bruce family. “Everyone was satisfied.”

Joe Jackson Seeking Up to $500M in Wrongful Death Lawsuit

A wrongful death lawsuit has been filed by Michael Jackson’s father, Joe Jackson, against his late son’s doctor, Conrad Murray.

According to court documents, Joe Jackson is seeking between $10 million and $500 million in compensation from Dr. Murray. Jackson calls the amount “realistic.” Of the possible compensation, 20 percent will cover loss of support, 40 percent for emotional distress, and the remaining 40 percent is for “loss of comfort, aid, society and companionship.”

Murray was Michael Jackson’s personal physician and was present at the time of his death on June 25 last year. He is accused of administering lethal levels of anesthetic that resulted in the pop singer’s death. Dr. Murray has been charged with involuntary manslaughter. He has pleaded not guilty, his trial is scehduled for January.

Murray has said he is unable to settle the wrongful death lawsuit because he is broke, and his insurance company will not cover him.

Wrongful Death Lawsuit Filed Against Disney Over Monorail Death

A preliminary hearing will be held in Orange County, Florida Thursday afternoon in the wrongful death lawsuit filed by the family of a Disney monorail driver who was killed on the job.

The wrongful death lawsuit, filed against the Disney Corporation, was brought by family members on behalf of 21 year-old Austin Wuenenberg, who was killed in a crash involving two monorail trains at Walt Disney World in July 2009. According to the lawsuit, Disney has not been forthcoming with information surrounding the incident. A lawyer for the Wunnenberg’s family said Thursday’s hearing involves a motion by the plaintiff to get more access to records that Disney claims are confidential.

An investigation into the incident by the Orange County Sheriff’s Office revealed the supervisor in charge of switching the two monorail trains was at an off-property restaurant at the time of the crash, and could not see the trains he was directing.
