Who can file a wrongful death suit?
Wrongful death suits can be filed by the deceased person’s surviving spouse, personal representative, parents or guardians, or children. Other relatives can only file the suit if they have been named as representatives or legal guardians of the deceased.
These suits are generally filed on behalf of another person; in other words, the person filing is not always the person who will receive benefits. The most common exception to this rule is lawsuits filed by spouses or parents of the deceased, who could also receive benefits.
